1. Operator and service
Spark is a social discovery service operated in Romania by Birloi Eduard Stefan and Patrinoiu Calin Petre under the NevetsInc brand. NevetsInc is not a registered company. These Terms apply to the Spark website, member features, guest access, and related public APIs.
- Spark: spark-v8.vercel.app.
- Operators: Birloi Eduard Stefan and Patrinoiu Calin Petre, using the NevetsInc brand.
- Support and legal inquiries: NevetsInc support.
- Contact information: Contact and Support.
“Spark,” “we,” and “us” refer to the service/operator in context; “you” refers to the person using it. Separate providers' terms can apply to their services.
2. Agreement and applicable rights
By creating an account or using Spark as a guest, you agree to these Terms to the extent a valid agreement can be formed under applicable law. If you do not agree, stop using the service and contact support if you need help with existing information.
The Privacy Policy is an explanation of processing, not blanket consent to every use of data. Optional features may need separate permission or authorization. Required consumer, privacy, child-protection, and other statutory rights take priority over conflicting wording.
Parents/guardians should review these Terms with younger users. Nothing here assumes a minor can waive legal protections or enter an agreement that local law does not permit.
3. Age and parental involvement
You must be at least 13 years old. If you are under 16, you need the consent of a parent or legal guardian under Spark's eligibility rule. You must also satisfy any additional requirements applicable where you live.
Give accurate age and account information. Do not use someone else's birthday, submit someone else's application, or help a person bypass an age or account restriction.
We may restrict access while investigating an account believed to be underage or lacking required consent. Report concerns through support with an account reference. A profile approval does not prove age or independently verified guardian consent.
4. Registration and account security
Use your own account and keep credentials secure. Do not sell, lend, transfer, or share an account, impersonate another person, or create accounts to evade a restriction. Guest features remain subject to the same conduct rules.
Use reasonable care to prevent unauthorized access. Tell support promptly if you suspect compromise, change your password where possible, and review authenticator and device access.
You are not automatically responsible for every unauthorized action regardless of circumstances. Responsibility depends on the facts and applicable law. Spark's own security and legal duties remain in effect.
5. Profiles, approval, and badges
Complete profile/application information honestly. The current review uses submitted profile information and gender selection. We do not conduct criminal background checks or certify school enrollment through this process.
An approved badge records an approval decision. A staff badge records a staff designation. Neither guarantees safety, identity, intentions, age, or future conduct.
Do not upload identity documents to ordinary profiles or chats. Questions about legacy verification documents belong through support and the Privacy Policy.
6. Respectful conduct
The Community guidelines apply to profiles, direct/group messages, statuses, uploads, calls, screen sharing, polls, invitations, and activities.
Do not harass, threaten, stalk, bully, discriminate against, dox, or repeatedly contact someone who has declined contact. Respect blocks and boundaries. Do not encourage violence or target someone with hateful abuse.
Profanity is not automatically censored. That does not authorize harassment, threats, or other prohibited conduct.
7. Sexual content and child safety
Sexual content is prohibited for everyone. Do not request, send, sell, or share intimate images, sexual solicitation, or explicit material. There is no adult mode or private-group exemption.
Grooming, sexual coercion, exploitation, trafficking, child sexual abuse material, and sexualized depictions of minors are prohibited. We may restrict accounts, preserve necessary evidence, and make legally required reports.
If you encounter abusive sexual imagery, do not download or forward it as evidence. Report the account/message reference and context through support. For immediate danger, contact emergency services.
8. Scams, spam, and harmful content
Do not use Spark for scams, requests for money, deceptive commercial solicitation, spam, stolen accounts, or impersonation. Do not upload malware or files intended to compromise a device or account.
Do not distribute unlawful content, content infringing another person's rights, or instructions intended to facilitate harm. Do not falsely claim to represent Spark or abuse a staff designation.
Unexpected payment, gift-card, password, sign-in-code, or intimate-image requests should be treated as a safety concern and reported.
9. Privacy and recording others
Respect other people's privacy. Do not publish another person's address, school schedule, documents, private conversations, or recordings without appropriate permission or other lawful authority.
A view-once label is not permission to copy or redistribute. Participation in a call is not blanket permission to record it. You are responsible for obtaining any consent required before recording or sharing another person's voice, image, or screen.
Protect confidential material during screen sharing. Close sensitive tabs and choose the intended window before sharing.
10. Messages and uploaded media
You may reply to messages and edit/delete your own messages within the available one-hour window. In-app deletion uses a placeholder and soft-deletion state, rather than guaranteeing permanent erasure of the original content or file.
Messages are stored by the service and are not end-to-end encrypted. Some uploaded files use public URLs; a person who obtains a working URL may access or retain the file.
View-once photos expire in the app after 24 hours and track opening per recipient in groups. Upload cleanup is best-effort. Screenshots, forwarded URLs, external copies, backups, and prior notifications can remain.
11. Groups, invitations, and statuses
Group owners/admins have feature permissions for membership, roles, invitations, and discoverability. They must use those tools consistently with these Terms and respect members' rights.
Invite codes may be forwarded. Resetting a code invalidates the previous code; it does not remove members who already joined. A private group is not a guarantee that members cannot copy its content.
Statuses display for 24 hours. Friends-only and public-to-signed-in-non-guests audiences differ; only friends can reply. Choose the audience before posting and assume recipients can retain a copy.
12. Calls, activities, and offline plans
Audio/video calls depend on device permission, browser support, connectivity, and available infrastructure. Participants may capture what they hear or see. Spark does not provide emergency calling.
Games, polls, shared activities, RSVP responses, and hangout plans are social coordination tools. They are not bookings, tickets, attendance guarantees, or supervision services. Calendar exports become separate copies.
Minimizing a call can leave your microphone/camera active while you navigate. Use call controls to mute, turn off the camera, or end the call.
13. Discovery and compatibility
Discovery modes use interests, preferences, available approximate location information, and permitted interaction history to order profiles. Adaptive learning can change ordering over time.
A compatibility score is an estimate, not a factual certification or promise of friendship, suitability, safety, or a particular outcome. You decide whom to contact and what to share.
Blocking, eligibility, and privacy rules can limit who appears. Guest accounts and accounts awaiting approval may have restricted features.
14. Safer interactions and meetings
Use judgment when interacting with someone online or offline. Do not send money, credentials, intimate images, or sensitive identity information to a person you met through Spark.
Under-18s should involve a parent or trusted adult and never meet someone from Spark alone. Choose a public setting, tell a trusted person the plan, arrange a safe way home, and leave if uncomfortable.
We cannot control independent member conduct or supervise meetings. This statement does not remove Spark's own legal obligations or liability where the law imposes it.
15. Your content and our limited license
You retain ownership of content you have the right to share. Give us a non-exclusive, worldwide, royalty-free license limited to operating the service: hosting, storing, transmitting, reproducing, and displaying it to the relevant audience, and processing it as necessary for safety/support or legal duties.
This does not transfer ownership or grant an unrestricted right to sell your private messages or use your photo in unrelated advertising. The license lasts only as needed for these purposes, including necessary shared history, backups, and lawful preservation after removal.
Only submit content you own or are authorized to use. Obtain required permissions for other people's likenesses, recordings, and copyrighted material. Statutory rights and lawful exceptions remain available.
16. Spark assets and public integrations
Spark's branding, original designs, and other protected assets belong to the relevant rights holders. Third-party and open-source components retain their own licenses.
You may use the service and public documentation as intended. Do not falsely imply endorsement, copy protected assets without permission, or misuse trademarks. See Brand and Developers.
Public documentation and AI-readable resources do not grant access to private member information. Respect authentication, authorization, and published rate limits.
17. Security and responsible reporting
Do not bypass access controls, scrape private member data, exploit accounts, disrupt the service, or evade rate limits. Do not use another member's credentials or a leaked file URL to abuse their privacy.
Report a suspected vulnerability privately through support or the published security contact. Provide a minimal description/reproduction without extracting unrelated personal data.
These restrictions do not override lawful security research, interoperability, open-source license rights, or other activities protected by applicable law.
18. Third-party services and advertisements
Optional Spotify, GIF/media, hosting, advertising, and call-connectivity providers operate their own services. You may need a separate account, permission, or agreement with them.
Advertisements and external links do not certify the advertised product, identity, safety, or commercial claims. The Ads page can contact Google advertising services and may involve cookies or other identifiers. Read the Privacy Policy and the provider's terms before using optional features.
Providers can change, restrict, or withdraw availability. Spark remains responsible for duties that applicable law places on its own processing and integration choices.
19. Reports, enforcement, and appeals
Report an account in the conversation menu or use support for concerns involving groups, statuses, intellectual property, or other features. Include relevant references, dates, and an accurate description. Do not submit knowingly false or abusive reports.
Depending on the facts, we may issue a warning, remove/restrict content, limit a feature, or suspend/terminate access. Where applicable, we provide reasons and information about appeal options. Notice may be delayed or restricted where law, evidence preservation, or immediate safety requires it.
Appeal through support with your account reference, decision details, and explanation. No particular outcome or continuous monitoring is guaranteed. Your rights to complain to a regulator or seek a court remedy remain available.
20. Deletion and ending access
You can stop using Spark and request deletion through Settings or support. Recent authentication and confirmation may be required. Review the Privacy Policy for shared content, recipient copies, backups, and lawful retention exceptions.
We may end access for a serious/repeated breach, an ineligible account, legal requirements, or necessary protection of the service and its members. Measures must respect applicable law and available appeal rights.
Provisions relevant to an existing dispute, necessary content retention, intellectual property, or obligations already incurred can continue after account closure, only to the extent legally appropriate.
21. Availability and service changes
Core Spark features are free. Spark+ is an optional subscription priced at 5 RON per month, including any configured tax, when purchases are available. Stripe Checkout displays the recurring price before payment. Subscriptions renew monthly until canceled. Manage payment methods, invoices and cancellation through Spark+ → Manage subscription. Cancellation at the end of the paid period keeps benefits until that period ends; it stops the next renewal. Contact support for billing errors, refund requests or any applicable consumer remedy. Your own internet, mobile-data or provider charges may also apply.
Spark+ includes paid profile appearance controls and enhanced video settings described in the shop. Requested video quality depends on your device, browser and connection. A Spark+ badge does not change profile verification or moderation. Sandbox purchases are tests and do not grant production benefits. Live purchases remain unavailable until payment setup is complete. People who cannot legally authorize a recurring purchase must involve their parent or legal guardian as required.
We aim to operate the service reliably, but cannot promise uninterrupted access, error-free delivery, universal browser support, permanent availability of a feature, or a particular social outcome.
Features may change for security, technical, legal, or product reasons. Where applicable law requires advance notice, consent, a remedy, or other protection for a change, those requirements apply.
22. Warranties and mandatory protections
To the extent lawful, Spark is provided “as is” and “as available.” We do not make an additional contractual promise that every member is trustworthy or that the service will satisfy every personal purpose.
This wording does not excuse failing to perform obligations imposed by law. Nothing limits consumer rights, privacy remedies, or other rights that cannot lawfully be limited or excluded.
No help article, badge, or marketing statement should be read as a promise of absolute security, screening, or successful relationships.
23. Responsibility and liability
Responsibility for a claim depends on its facts and applicable law. Independent member conduct and third-party failures are not automatically attributable to Spark, but this does not excuse a breach of Spark's own duties.
Where law permits, we exclude liability for business losses, lost profits, and remote or unforeseeable consequential losses arising from personal use of the service. This exclusion applies only where valid, fair, and compatible with your mandatory rights.
We do not exclude or limit liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. There is no blanket waiver of privacy compensation, statutory remedies, or access to court, and no promise that these Terms prevent a lawsuit.
24. Governing law and disputes
These Terms are governed by the laws of Romania, subject to mandatory protections applicable to you. Consumers retain any non-waivable protection and jurisdiction right provided by their country of residence or applicable law.
You may contact support to try to resolve a problem. Doing so is not a required waiver of court, regulator, complaint, or other legal rights, and does not suspend a legal deadline unless law or a valid agreement provides otherwise.
EU consumers can consult the European Commission Consumer Redress portal. Nothing here requires private arbitration or prohibits participation in a legally available collective remedy.
25. Changes and interpretation
We update the date when these Terms change. Material changes receive notice or renewed agreement where required by law. Changes do not automatically rewrite the legal terms of an earlier event or claim.
If a provision is invalid, remaining provisions continue only where legally possible. Ambiguous consumer terms are interpreted as applicable law requires. A delay in enforcement does not automatically waive an available right.
The Privacy Policy governs data-processing explanations; these Terms govern service use. Mandatory law takes priority if either document conflicts with it.
26. Contact
For account questions, appeals, legal notices, or a concern about these Terms, contact NevetsInc support and identify the request as relating to Spark.
Include an account or content reference and the issue you need addressed. Never include passwords or sign-in codes. Use Help for troubleshooting, Privacy for data rights, and Contact for reporting guidance.
